Mindsarthi (mindsarthi.com) is an online Platform operated from India that connects students, parents, and individuals ("Users") with independent, self-employed mentors and psychologists ("Mentors"). By accessing or using Mindsarthi in any way — including browsing, registering, booking, or providing services — you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, please stop using the platform immediately.

Mindsarthi is a technology intermediary as defined under the Information Technology Act, 2000 (India) and acts solely as a Platform facilitating connections. We are not a mental health clinic, hospital, or healthcare provider.

• You must be at least 18 years old to register independently. Users under 18 must have a parent or legal guardian register and provide consent on their behalf.
• Mentors must be legally eligible to provide mentorship services in India and hold valid qualifications or registrations as declared during sign-up.
• By registering, you confirm that all information you provide is accurate, complete, and current.

Mindsarthi provides a platform where:

• Mentors can list their services, availability, qualifications, and fees.
• Users can discover, compare, and book sessions with Mentors.
• Communication, booking confirmation, and payment coordination happen through or facilitated by the platform.

Important: The mentorship or psychological services are provided entirely by independent Mentors. Mindsarthi does not employ Mentors, supervise sessions, or guarantee therapeutic outcomes. Each Mentor is solely responsible for the quality, legality, and appropriateness of the services they deliver.

As a User (student, parent, or individual seeking mentorship), you agree to:

• Use the platform only for lawful purposes and in good faith.
• Provide accurate personal and contact information during registration.
• Attend booked sessions on time or cancel within the permitted window.
• Treat Mentors with respect during all interactions.
• Not record, screenshot, or share session content without the Mentor's explicit consent.
• Not misuse the platform to harass, defame, or harm any Mentor or other User.
• Understand that mentorship is not a substitute for emergency psychiatric care. In a mental health emergency, please contact iCall: 9152987821 or your nearest hospital.

As a Mentor listed on Mindsarthi, you agree to:

• Provide accurate information about your qualifications, experience, specialisations, and fees.
• Maintain any professional registrations or licences required by applicable Indian law (e.g., RCI registration where applicable).
• Provide services with reasonable skill, care, and diligence.
• Maintain strict confidentiality of all client information, except where disclosure is required by law (e.g., imminent risk of harm).
• Not solicit Users to transact outside the platform to circumvent Mindsarthi's fee structure.
• Promptly update your profile if your qualifications, availability, or contact details change.
• Comply with all applicable ethical guidelines including those of the Indian Association of Clinical Mentors (IACP) or equivalent bodies.

• Booking confirmation — A booking is confirmed only after Mindsarthi or the Mentor confirms acceptance.
• Payment — Fees are collected or coordinated by Mindsarthi as per the fee displayed on the Mentor's profile. Payment links are shared via WhatsApp or the platform. Prices are in Indian Rupees (₹) and inclusive of any applicable taxes unless stated otherwise.
• Cancellations by Users — Cancellations made more than 24 hours before a session may be eligible for a credit or refund at Mindsarthi's discretion. Cancellations within 24 hours are non-refundable.
• Cancellations by Mentors — If a Mentor cancels a confirmed session, the User will receive a full credit or refund.
• No-shows — Failure to attend a session without cancellation forfeits any refund entitlement.
• Disputes — Payment disputes should be raised within 7 days of the session date by emailing hello@mindsarthi.com.

Mindsarthi is committed to protecting your personal information in accordance with the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and applicable Indian data protection laws.

What we collect:

• Identity data: name, email address, phone number, city.
• Profile data: qualifications, experience, bio (Mentors only).
• Booking data: session dates, times, concerns shared during booking.
• Usage data: pages visited, device type, IP address (for security and analytics).
• Communications: enquiries, remarks, and messages sent through the platform.

How we use it:

• To operate and improve the Mindsarthi platform.
• To match Users with Mentors and facilitate bookings.
• To send booking confirmations, payment links, and service updates via WhatsApp/email.
• To maintain platform security and prevent fraud.
• We do not sell your personal data to third parties.

Data sharing: We share your data only with the Mentor you have booked with (name and contact for session coordination) and with service providers (e.g., hosting, analytics) bound by confidentiality obligations.

Data retention: We retain account data for as long as your account is active and for up to 3 years thereafter for legal and accounting purposes.

Your rights: You may request access to, correction of, or deletion of your personal data by emailing hello@mindsarthi.com. Deletion requests will be processed within 30 days.

Cookies: We use essential session cookies to keep you logged in. We do not use advertising or tracking cookies.

Session content shared between a User and a Mentor is confidential. Mindsarthi staff do not have access to session content unless voluntarily shared via the platform's remark system. Mentors are bound by professional confidentiality obligations. Disclosure may only occur where required by law or to prevent serious and imminent harm.

All content on Mindsarthi — including text, design, logos, and code — is the intellectual property of Mindsarthi or its licensors. You may not reproduce, distribute, or create derivative works without prior written permission. Mentors retain ownership of their profile content but grant Mindsarthi a non-exclusive licence to display it on the platform.

To the fullest extent permitted by Indian law:

• Mindsarthi is not liable for the quality, safety, or legality of services provided by Mentors.
• Mindsarthi is not liable for any psychological, emotional, or physical harm resulting from a mentorship session.
• Our total aggregate liability for any claim arising out of use of the platform shall not exceed the amount you paid for the booking in question.
• Mindsarthi is not liable for service interruptions, data loss, or third-party actions beyond our reasonable control.

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Solapur, Maharashtra. We encourage Users and Mentors to first attempt resolution through our support team at hello@mindsarthi.com before initiating legal proceedings.

Mindsarthi reserves the right to update these Terms at any time. Material changes will be notified via email or a prominent notice on the platform. Continued use of the platform after changes constitutes acceptance of the revised Terms.
